Within the framework of the General Conditions of Sale, the terms ‘seller’, ‘us’ or ‘A La Bonne Heure’ refer to the Belgian company SPRL A La Bonne Heure Au Sablon.

Within the framework of the General Conditions of Sale, the terms ‘buyer’ or ‘you’ refer to the person placing the order.
The seller has the right to request that the buyer provide certain information (full name, address, head office, VAT number, the identity, and powers of its representatives, etc.). Only individual customers and “end user” companies buying for purposes other than resale may place orders on the alabonneheure.com site. The resale or distribution of items purchased on alabonneheure.com is strictly prohibited.
The buyer declares they have the necessary full legal capacity.

5- product availability and production delays
Our products are sold subject to availability. When placing your order, ensure that the number, size and price of each item are mentioned correctly on your purchase order.
When a product is no longer available, it will be marked in the basket with an “Available on backorder” option.
By accepting the purchase and confirming the “Available on backorder” product, you accept the production delays.
The production delays of “Available on backorder” products might vary according to the designer’s stock from 7 days up to 60 days. Delays might sometimes exceed 60days because of the complexity and craftmanship of the selected product.
Once you have placed an order, in both cases for “in stock” products and “available on backorder” products, we will not be able to make changes to the order.
As soon as you confirm an order for products “Available on backorder”, we will launch the production and will contact you as soon as possible with detailed delays.
Contact us if you have any question, our team will be glad to answer your questions and proceed as fast as possible with the production of your jewel.
6 – ORDERS
When placing your first order, you must create an online account with your personal contact information and keep this up to date. The contract is deemed to have been entered into once A LA BONNE HEURE receives the electronic order form and once the order details have been verified. Before submitting the order form to purchase a product, you are asked to read these Terms and Conditions carefully. Electronically submitting the order form signifies your unconditional acceptance and agreement to abide by these Terms and Conditions in dealing with A LA BONNE HEURE.
If you do not accept the terms laid out in these Terms and Conditions, please do not submit your order form for the purchase of items on alabonenheure.com.
Before definitively validating the order, you will be able to check the details, the total price and to correct possible errors, before confirming it. With the order validation, you confirm to accept the delivery details linked to the selected item (in “stock” or “Available on backorder”, please see point 5.) and the chosen shipment method.
While all efforts are made to ensure that the outer features of A LA BONNE HEURE products that are displayed on the website are faithful to the original products, variations may occur, particularly due to technical colour-rendering limits on your computer equipment and natural stone variations. Consequently, the seller cannot be held responsible for errors or inaccuracies in relation to the colour or patterns in photographs or graphical representations of A LA BONNE HEURE products featured on the website.

7- AVAILABLE ON BACK ORDER PRODUCTS
If a jewel is marked as “available on backorder” it means that this jewel is specially ordered and/or created for you and following your request.
For this reason, the seven-days right of withdrawal for “available on backorder” products cannot be exercised except for jewels without size or for rings included in the range size from 49 to 56.
Before definitively validating a product mentioning “available on backorder”, you will be able to check the details, the total price and to correct possible errors. With the validation of the purchase of an “available on backorder product”, you confirm to accept the delivery delays linked to the production of the item.
Once you have confirmed the purchase of an “available on backorder product”, it is not possible to change or cancel the order.
This includes size changes and quantities.
If you purchase an “available on backorder” jewel, you will be required to pay a 100% of the amount due at the time you place your order, as well of shipping fees and taxes.
Once the jewel is ready for shipment, you will receive an email notification prompting that your jewel is ready and we’ll send you the tracking information.
Please be aware that because of the “pre-sale” nature of such transactions, you should expect a wait period that will vary according to the designer’s stock. (see article 5 : Product Availability and production delays).
8 – PRICES AND PAYMENT
The prices of our products are given in euros, inclusive of all taxes. Prices exclude delivery charges. All orders must be paid in euros. A LA BONNE HEURE reserves the right to change prices at any time, but products will be billed according to the prices in effect at the time the order is processed, subject to availability. After clicking on “order” you may choose one of the following payment options:
– Credit card payment: MasterCard®, Visa® and BEL BANCONTACT®
Your order will be dispatched once your bank has validated your means of payment and the transfer has been credited to our account.
9 – CONFIRMATION
The information recorded by A LA BONNE HEURE when an order is confirmed constitutes proof of all transactions between A LA BONNE HEURE and its customers. The information recorded by the payment system constitutes proof of financial transactions.
10 -DELIVERY and RETURNS
Products purchased on alabonneheure.com are shipped according to the terms described under this chapter.
10-1. Shipping and Deliveries – use of your personal data
For safety reasons, A LA BONNE HEURE will not process orders to any post office boxes.
In order for delivery to be assured, you agree to provide your full and accurate address when placing your order, including any additional information deemed necessary, such as your building number, floor or door access code when applicable.
10-2. Shipping and Deliveries – Collect in store
It is also possible to organize a ‘’Collect-in-Store’’. We kindly ask you to present yourself with a valid ID after receiving the message that your purchase is ready.
The collect address is in our boutique A LA BONNE HEURE, 2a rue Bodenbroek (place du Grand Sablon), 1000 Bruxelles.
Please note that orders placed online can be collected in the store only during opening hours:

10-3. Shipping and Deliveries – Delivery zones
Once the payment for the order has been registered, the articles will be delivered to the delivery address that you indicated during the ordering process. Any delivery address outside the buyer’s country of residence may be refused during the ordering process.
We deliver in Europe as explained in this chart.
DELIVERY ZONES AND FEES
Deliveries to countries belonging to European countries but outside Europe are not considered as European deliveries (it is not possible to deliver to French overseas territories by selecting France as the delivery country, for example in the DOMTOM). Overseas territories are considered as countries outside Europe from a logistics and customs point of view.
Deliveries outside Europe are also possible but we ask you to contact our customer service beforehand: email@example.com.
We will always provide you with a tracking number.

10-5. Shipping and Deliveries – Delivery times for products in stock
We have different carriers depending on the value of the package. We will always provide you with a tracking number.
We undertake to deliver the items ordered as soon as possible and at the latest within 2 working days after the order, subject to full payment of the price. During the ordering procedure, the seller will stipulate the possible delivery times and methods for the products purchased.
This delivery time is indicative and may be modified: in this case, you will be informed directly.
10-6. Shipping and Deliveries – Delivery times for products “Available on backorder”
If your product is not in stock and we should produce it on demand for you, we will inform you about the detailed production delays and delivery dates after receiving the confirmation of your order.
10-7. Shipping and Deliveries – Delivery problems
If, upon delivery, the appearance of the package is not perfect, the buyer will proceed to open it in the presence of the delivery person to check the condition of the item.
10-8. Shipping and Deliveries – Right of Withdrawal
You have the right to withdraw from this contract without giving a reason within 14 days after delivery.
The right of withdrawal only applies if:

10-9. Shipping and Deliveries – Exchanges
The buyer can return any product purchased on the website for exchange within 14 days of the delivery date if:
The recipient of a gift may exercise the right to exchange, bearing in mind that in the case of a remote exchange via A LA BONNE HEURE aftersales department, the recipient of the gift will not be refunded if there is a difference in price.
10-10. Shipping and Deliveries – Compliance – Warranty
Upon delivery, the buyer must ensure that the articles delivered correspond to their order. The products sold on the website are subject to legal warranty conditions. The seller is bound by the warranty concerning hidden defects that render the item sold unfit for the usual use for which it is intended, or diminishes that use in such a way that the buyer would not have bought it, or would only have paid a lower price, if they had known about them . If the product is non-compliant or faulty, excluding damages, the seller can freely choose between replacing the product, repairing it, or offering a discount. The seller is entitled to replace or repair the product several times in succession.
Warranties no longer apply in the event of abnormal use, treatment or handling of the product or in the event of use, treatment or handling of the product that is contrary to normal use. Warranties do not apply in case of damages caused to the product.
10-11. Shipping and Deliveries – Limitation of liability
Under no circumstances can the seller be held liable for any indirect, incidental, special, or consequential damages that result from the purchase of products on the A LA BONNE HEURE website. The seller can only be held liable, whether in tort or contract, for direct damage caused to the buyer or any other person as a result of fraud (fraudulent misrepresentation) committed by the seller, subject to the mandatory provisions of the Belgian law of 25 February 1991 on liability for defective products.

Customs duties, local taxes, import duties or taxes of State may be due.
The costs and taxes related to the delivery of an item are not billed by, nor part of A LA BONNE HEURE Store’s responsibility, but are dependent on and borne to the buyer.
A LA BONNE HEURE Jewelry is committed to providing only high-quality products.
Should you for any reason want to return an item, you may choose to exchange it or to return it, for a full refund/exchange.
The recipient of a gift may exercise the right to exchange, but will not be refunded.
In the case of a refund, the original buyer will be credited in the way that matches the original payment method used or by bank transfer.
Please note that refunds may take up to 15 days to complete following the reception of your return.
A LA BONNE HEURE reserves the right to deduct any additional bank charges and commissions connected with the method of payment.
The delivery fees incurred when returning products will only be refunded if the return is justified by the non-compliance of the products delivered (reference error).
A LA BONNE HEURE will not be responsible in the event of loss, shipment to the wrong address or late delivery of a product that the buyer wishes to return to the seller. The risks pertaining to the transport you choose and instigate are your sole responsibility.
We recommend you to use the original shipping method for returns. Returned jewelry must arrive unworn, in pristine condition and in their original packaging.

11. CLAIMS – INFORMATION
For all information, claims, complaints or questions relating to the General Terms and Conditions of Sale, customers should contact A LA BONNE HEURE Aftersales Service, address, telephone, e-mail firstname.lastname@example.org mentioning their order number where applicable.
12. FORCE MAJEURE
Fulfilment of the seller’s obligations in full or in part will be suspended in the case of a fortuitous event or force majeure that would hinder or delay them. These include, but are not limited to, wars, riots, demonstrations, social unrest, pandemics, and health crises, strikes of all kinds and problems in supplying the seller.
15. DISPUTE RESOLUTION
These terms are governed by Belgian law and you can bring legal proceedings in respect of the products in the Belgian courts.
18. INTELLECTUAL PROPERTY RIGHTS
The A LA BONNE HEURE brand, along with all brands, illustrations, images and logos featured on alabonneheure.com and all intellectual property rights associated with A LA BONNE HEURE articles, their expertise, accessories and packaging, whether or not they are registered, are and remain the exclusive property of A LA BONNE HEURE or their respective assignees. Any total or partial reproduction, modification or use of these brands, illustrations, images, etc. for any purpose and on any medium whatsoever, without the express prior consent of A LA BONNE HEURE, is strictly forbidden.
This is also the case for the texts, copyright, drawings, models, and patents that are the property of the seller.
